Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aurea Health mobile application, website, and related services (collectively, the "Services") provided by Aurea Health, Inc. ("Aurea Health," "we," "us," or "our"). By using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age to use the Services. By creating an account, you represent that you are at least 18 years old and that all information you provide is accurate and complete.
2. Description of Services
Aurea Health provides a technology platform that connects patients with licensed healthcare providers for:
- Telehealth consultations and follow-up care
- Health data monitoring and biometric dashboards (via wearable integrations and Apple HealthKit)
- Secure messaging with your care team
- Electronic prescriptions and lab ordering
- AI-assisted health insights and personalized recommendations
3. Medical Disclaimer
Aurea Health is a technology platform — not a healthcare provider. Clinical services are provided by independently licensed physicians and clinicians who use our platform to deliver care. We facilitate connections between patients and providers but do not practice medicine.
- Health insights, biometric dashboards, and AI-generated recommendations are informational only and do not constitute medical advice, diagnosis, or treatment.
- Always consult your healthcare provider before making decisions based on information displayed in the app.
- In case of a medical emergency, call 911 or go to your nearest emergency room. The Services are not designed for emergency or life-threatening situations.
4. Account Responsibilities
- You are responsible for maintaining the security of your account credentials.
- You must not share your account or grant access to unauthorized individuals.
- You agree to provide accurate and current information and to update it as necessary.
- You must immediately notify us of any unauthorized use of your account.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Impersonate another person or misrepresent your identity
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any part of the Services
- Reverse engineer, decompile, or disassemble the application
- Transmit any malicious code or content
6. Fees & Payment
- Certain services may require payment, including consultation fees, subscription plans, or lab work costs.
- Payment processing is handled by Stripe, Inc. We do not store your full credit card information on our servers.
- Fees are non-refundable unless otherwise specified or required by law.
- We will notify you of any fee changes at least 30 days in advance.
7. Intellectual Property
The Services, including all content, features, functionality, software, design, and branding, are owned by Aurea Health, Inc. and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial healthcare purposes.
8. Privacy
Your use of the Services is also governed by our Privacy Policy and our HIPAA Notice of Privacy Practices, which describe how we collect, use, and protect your information.
9. Termination
- You may deactivate your account at any time through the app settings.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your right to use the Services ceases immediately. Clinical records will be retained per our Data Retention Policy and applicable law.
10. Limitation of Liability
To the maximum extent permitted by law, Aurea Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to damages for loss of data, health outcomes, or interruption of service.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid to Aurea Health in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Aurea Health, its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Services or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
